As of 1 August 2018 changes will be in place to the automatic disqualification rules (for England and Wales registered charities) which means that there are more restrictions on who is able to run a charity.

As stated by the Charity Commission, there are two key changes to adhere to as of 1 August:

  • an increase in the number of legal reasons that disqualify someone from acting as a trustee. The new reasons include being on the sex offenders register, and certain unspent convictions - such as for terrorism or money laundering
  • people who are disqualified from acting as a trustee are also disqualified from holding certain senior manager positions at a charity

For most charities there are some simple steps that need to be taken to ensure they comply with the new changes, just around the systems that are used to appoint and recruit people to become trustees.
